Gifted Norwich Terms and Conditions
Introduction
- Welcome to Gifted Norwich’s website, a directory website designed to facilitate live gift exchange events (“Events”).
- The Gifted Norwich Event is organised and run by Gifted Exchange CIC, a community interest company registered in England & Wales with company number 15598566. We also use the terms “us” and “we” in these Terms to refer to Gifted Exchange CIC.
- By using our website and registering and participating in Events, you agree to these Terms and Conditions (“Terms”).
- We reserve the right to modify these Terms at any time. Changes will be posted on the website, and your continued use signifies your acceptance.
- For the purposes of these Terms, the following definitions and interpretations shall apply:
- “Gifted Norwich Event” means the live gift exchange organised and run by Gifted Exchange CIC to which these Terms apply.
- “Gift” means the gift or donation provided by a Gifter in relation to the Gifted Norwich Event.
- “Gifter” means a participant of the Gifted Norwich Event who gives or donates a Gift.
- “Recipient” means a participant of the Gifted Norwich Event who receives a Gift.
- “You” means you, the party subject to these Terms whether as a Gifter and/or Recipient accordingly.
User Accounts
- To participate in the Gifted Norwich Event, you must register an account with us at giftednorwich.com, providing accurate information (name, email, etc.). We will only use the personal data you use to register with us for the purposes set out in our Privacy Policy, available at https://giftednorwich.com/privacy-policy/.
- You are responsible for maintaining the confidentiality of your account credentials, including any chosen passwords.
- We may suspend or terminate accounts at our discretion, including for violations of these Terms.
- In order to participate in the Gifted Norwich Event, you will be required to donate a Gift. Donation of a Gift is a prerequisite of, and will entitle you to be, a Recipient of a Gift from the Gifted Norwich Event.
- If you are a business, as part of the registration process, you can select to only donate a Gift should you wish.
- All entrants into the Gifted Norwich Event must have registered an account with us by 1st October 2024 to be eligible to receive a Gift from the Gifted Norwich Event.
- All entrants must be of 18 years of age or older and by entering into the Gifted Norwich Event, you confirm that you are eligible to do so, and we may require you to provide proof that you are eligible to enter and be a Recipient of a Gift.
- We will not be responsible for any entries which are not received by us, regardless of the cause.
Gifts and Gifted Exchange
· All Gifts:
o must be a physical product; a handmade item; a service or experience; or a gift card;
o must be free of charge to the Recipient;
o must not be subject to the satisfaction of any prior obligations on the Recipient (including, for example, the payment for a product in order to benefit from a discount or offer where the discount or offer is the ‘Gift’);
o must bear a value of around £10 minimum.
- All donated Gifts and registration applications will be vetted for approval by us, and we reserve the right at our sole discretion to refuse any registration application and/or Gifts as we deem appropriate.
· In respect of the delivery of the Gifts:
o for those Gifts donated by a business which requires the Gift to be collected from the business, we will ensure said business’s details are contained within the Gift when opened by the Recipient, which will explain to the Recipient the means of claiming the Gift from the business Gifter;
o for those physical Gifts donated by an individual, the individual will be required to deliver the Gift to New-U at Level 2, 75 Castle Quarter, Norwich, NR1 3DD. All such Gifts must be provided to New-U by 30th September 2024. The Recipients of such Gifts will be required to take their confirmation card from the exchange event to “New-U” as evidence that they are the Recipient of such Gift;
o for those services or experience Gifts donated by an individual, the individual’s details will be shared with the Recipient of such Gift to allow them to contact the Gifter directly in order to organise use or collection of the Gift from the Gifter, and in donating such a Gift, the Gifter agrees to Gifted Exchange CIC sharing their details for this purpose only.
· The Gifted Norwich Event will be held on 1st October 2024 at The Forum, Millenium Plain, Norwich, NR2 1TF. Should the date and/or location of the Gifted Norwich Event need to be amended for whatever reason, we will contact all entrants and participants to notify them.
· Recipients will be allocated Gifts entirely at random and will receive notification of the Gift they have received at the Gifted Norwich Event.
· Use of all Gifts are subject to any obligations or conditions placed on the Recipient by the Gifter and we have no liability should you be unable to make use of the Gift as a result of such conditions.
Gifter Conduct and Responsibility
- You are solely responsible for your interactions with other users, both within and outside of Events and the Gifted Norwich Event.
- You must behave respectfully and refrain from harassment, discrimination, illegal activity, or the exchange of inappropriate content.
- We make no guarantee or warranty in respect of the Gifts in any way, and are NOT responsible or liable for:
- Gifts promised but not delivered;
- Gifts not meeting expectations;
- Any losses, damages, or injuries arising from participation in an Event or interactions with other users;
- Your inability to take up the Gift for whatever reason.
- Gifts are subject to availability and no Gift may be exchanged for an alternative Gift or for a cash alternative. Recipients are able to donate their Gift to the Gifted Exchange CIC’s chosen charity, “New-U” should they wish.
- All Gifts must be claimed by 31st October 2024.
- Any Gifts donated but not claimed by the above deadline date, will be donated to auction where the monies raised from the sale of the Gifts at auction will be donated to “New-U”, a charitable company with Charity Number 1186761.
- Insofar as is permitted by law, we will not in any circumstance be responsible or liable to compensate you or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a Gift except where it is caused by our negligence. We are also not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our website or participation in an Event, including the Gifted Norwich Event.
Intellectual Property
- You retain ownership of any content you submit to the website (profile information, etc.).
- Where you are a Gifter, you retain ownership of any intellectual property rights vested in the Gift you have created (where applicable) and you shall be responsible for any terms on which, or limitations, of any licence or assignment to the Recipient as may be necessary.
- By submitting content, you grant us a non-exclusive license to use, modify, and distribute it in connection with operating the website and the Gifted Norwich Event. For example, we might choose to highlight your Gift on our website for the purposes of advertising the Gifted Norwich Event and you grant us the right to do so.
- You are responsible for ensuring you have the rights to any content you share.
Indemnification
- You agree to indemnify and hold Gifted Norwich and its affiliates harmless from any claims, losses, or expenses arising from your use of the website, breach of these Terms or any claim brought against us by a Recipient of your Gift for whatever reason.
General
- These Terms will be governed by English Laws and any disputes relating to these Terms shall be governed by the courts of England and Wales.
- Any disputes will first be attempted to be resolved through informal negotiation.
- These Terms constitute the entire agreement between you and Gifted Exchange CIC regarding the website and the Events.
- If any part of these Terms is found unenforceable, the remaining portions will remain valid.
